The scope, deliverables, timelines, and pricing of all services are agreed upon separately through individual client proposals, service agreements, or engagement letters before work commences.
Kongzilla reserves the right to refuse service to any individual or business at our sole discretion without obligation to provide a reason.
Client Responsibilities
As a client or user of our services, you agree to:
- Provide accurate, complete, and up-to-date information required for service delivery
- Grant Kongzilla necessary access to platforms, accounts, and assets required to perform agreed services
- Review and approve deliverables within agreed timelines to avoid project delays
- Ensure all materials, content, and assets provided to Kongzilla are owned by you or that you have the necessary rights and permissions to use them
- Not engage in any activity that violates applicable laws or regulations in connection with our services
Failure to meet these responsibilities may result in delays, additional charges, or termination of services without refund.
Intellectual Property Rights
All content on the Kongzilla website, including but not limited to text, graphics, logos, images, audio, video, and software, is the intellectual property of Kongzilla Creative Digital Agency Pvt Ltd and is protected under applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and view our website content for personal and informational purposes only. Payment Terms
All payments for Kongzilla’s services are governed by the terms outlined in individual client proposals or service agreements. Unless otherwise agreed in writing:
- A deposit or advance payment may be required before work commences
- Remaining balances are due upon project completion or as per agreed milestone schedule
- Late payments may result in suspension of services until outstanding amounts are settled
- All prices are exclusive of applicable taxes unless stated otherwise
Kongzilla reserves the right to revise pricing for ongoing services with reasonable advance notice to the client.
Refund and Cancellation Policy
Refunds are subject to the terms outlined in individual service agreements. In general:
- Deposits and advance payments are non-refundable once work has commenced
- Clients may cancel ongoing retainer services with written notice as specified in their service agreement
- Completed work or delivered milestones are non-refundable regardless of the reason for cancellation
- Kongzilla does not offer refunds for dissatisfaction arising from subjective preferences not communicated during the brief or approval stages

Results and Performance Disclaimer

However, we do not guarantee specific results including but not limited to search engine rankings, traffic volumes, lead generation numbers, or revenue outcomes. Digital marketing performance is subject to factors outside Kongzilla’s control including search engine algorithm updates, market conditions, and platform policy changes.
Any projections, forecasts, or estimates provided during the sales or onboarding process are indicative only and do not constitute a guarantee of performance.
Third-Party Platforms and Tools
Kongzilla uses various third-party platforms, tools, and services to deliver our digital marketing services, including but not limited to Google Ads, Meta Ads Manager, SEMrush, Ahrefs, and social media platforms. Your use of these platforms through our services is also subject to their respective terms and conditions and privacy policies. Kongzilla is not responsible for any changes, outages, policy updates, or actions taken by third-party platforms that may affect service delivery or results.
Limitation of Liability
To the fullest extent permitted by applicable law, Kongzilla Creative Digital Agency Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of our website or services, even if we have been advised of the possibility of such damages.
Our total liability to any client for any claim arising out of or relating to our services shall not exceed the total amount paid by that client for the specific service giving rise to the claim in the three months preceding the dispute.
